General terms and conditions for participating in tours with Berlins Taiga (effective 01.07.2019)

Scope of application

The following general terms and conditions govern the legal relations between the participants (subsequently clients) in tours (public tours and private group tours) and other activities of the company "Berlins Taiga". When booking, the client acknowledges these conditions.

Services

The scope of the contractual services is given by the description of the respective tour of Berlins Taiga. Supplementary agreements require written confirmation by the organizer.

Registration & Confirmation

The registration is made in writing by online booking, telephone, letter or e-mail. When you book online, you will be asked to make a binding registration for the selected tour.

The registration is legally binding by a written confirmation from Berlins Taiga. The confirmation will be sent by e-mail to the client and may contain additional information.

Is a booking confirmation by Berlins Taiga impossible due to date collision or for other reasons, Berlins Taiga is entitled to forward the request to a cooperation partner. All further agreements - in particular the contractual provisions - are the responsibility of the cooperating partner. Berlins Taiga accepts no liability for a mediated order.

Fees and terms of payment

The amount shown on the website of Berlins Taiga is the gross amount. Payment is made online via the online booking system, via transaction to the company´s bank account or via transaction to the company´s Paypal account.

In the case of private group tours, which do not take place via the booking system of the website www.berlinstaiga.de, the full invoice sum is due within 7 days after the invoice date.

Only after the full payment of the tour the client has a right to participate in the tour.

In exceptional cases and in consultation with the contractor, a cash payment is possible on site. The amount must be paid in full before the start of the tour.

Invoices are issued on request. This must be announced by the clients independently.

Third-party services (costs for the use of public transport, entrance fees, etc.) are not included in the fee, unless explicitly agreed. In particular, valid tickets for the use of public means of transport must be brought by the client independently if necessary for the planned tour.

Waiting period

Public guided tours begin on time. Therefore, clients must arrive 15 minutes before the start of the tour at the designated meeting point. If the client does not arrive at the meeting point at the scheduled time, there is no entitlement to a refund of the fee.

For private group tours, the tour guide will wait 30 minutes. If the group does not appear during this period, the entire fee is required. In case of a delay, the group can call Berlins Taiga to inform the guide about the delay. In case of a late arrival of the group, there is no claim to the originally agreed duration of the tour. The tour can be reduced without compensation by the duration of the delay so that the program can deviate from the originally agreed program. The decision is solely to the guide.

Liabilities

Berlins Taiga is not liable for the services of third parties (eg transport by public transport).

In the case of the participation of minors or other persons in need of supervision, the supervisory duty is solely the responsibility of the client, not of the tour guide.

Berlins Taiga shall not be liable for self-responsible damage to property or body of the client during the tour, as well as for the loss or damage of objects of the clients, unless intent or gross negligence on the part of Berlins Taiga or the guide.

Force majeure

By force majeure such as extreme weather events, short-term road blockages, police operations during State visits, disturbances in the course of public transport or other unpredictable events, Berlins Taiga may shorten the duration of the tour or change the itinerary of the tour, which may deviate from the planned program.

Concerns Van Excursions:

Due to unforeseen technical problems of the vehicle, which require a repair, the excursion can be canceled or shortened. The client will be informed immediately and will be refunded or an alternative date will be appointed.

Limitations of liability

For some objects, it is also necessary to issue a disclaimer of liability towards the owner or owner of the object, as well as towards Berlins Taiga. The disclaimer of liability must be signed by hand before entering the object

Important conditions

Some of our tours take place in or on special objects or areas, for which certain rules apply. This is particularly the case with previously used military objects. The instructions of Berlins Taiga must be followed.

Photographing is prohibited on some of the properties on our tours. Follow all relevant instructions. The instructions of the guide of Berlins Taiga are compulsory.

Film and video recordings or the use of a tripod are not permitted in general. Pictures and sound recordings of the tour itself and especially the person of the guide is not permitted.

Cancellation of a service by the client

Applies to private tours:

The client can withdraw from the reservation at any time prior to commencement of the booked event / tour without stating reasons. The receipt of the cancellation notice by the organizer shall be decisive. The cancellation must be made in writing and confirmed by the organizer.

In case of non-attendance of the client, he can nominate a substitute who takes part in the tour.

In case of cancellation by the client, the following cancellation fees will be charged:

Concerns Walking Tours, Bicycle Tours or Kayak-Tours:

Up to 7 calendar days prior to the start of the tour, no cancellation charges apply.

Up to 4 calendar days before the start of the tour: 30% of the fee,

Up to 48 hours before the start of the tour: 60% of the fee,

Less than 48 hours before the start of the tour: 90% of the charge

In the event of non-attendance, the total remuneration is to be paid or no refund of the already paid remuneration is made.

Concerns Van Excursions:

Up to 14 calendar days prior to the start of the tour, no cancellation charges apply.

Up to 7 calendar days before the start of the tour: 30% of the fee,

Up to 48 hours before the start of the tour: 60% of the fee,

Less than 48 hours before the start of the tour: 90% of the charge

In the event of non-attendance, the total remuneration is to be paid or no refund of the already paid remuneration is made.

Any costs incurred by third parties resulting from the cancellation of agreed services by third parties may be invoiced to the client.

Cancellation or termination of a service or exclusion of clients by Berlins Taiga

In case of sudden illness of the guide, Berlins Taiga tries to find a short-term replacement. If no replacement is found, the tour will be canceled and the opportunity to participate in a replacement date will be announced. The clients are immediately informed about the cancellation and the possibility of a new appointment via the data collected in the booking data (telephone, email address). In the case of an adjournment, the clients can choose between the participation in the alternative offered date and the reimbursement of the fee which has already been paid. If the clients opt for the replacement date, they receive a voucher in the value of the canceled tour. In the case of the reimbursement of the previously paid remuneration, the reimbursement is immediately arranged by Berlins Taiga.

Berlins Taiga also has the right to resign if the minimum number of participants is not reached for public tours until 6 p.m. the day before the tour.

For Walking Tours the minimum number of participants is: 6
For Van Excursions the minimum number of participants is: 4

In this case as well, the clients will be informed, they will be offered a voucher, or the fee will be refunded.

Any further claims of the clients against Berlins Taiga, in particular claims for damages (including cancellation fees for travel or hotel costs) in the case of changes or cancellations of a tour, do not exist.

In the case of private group tours, deviations of the number of participants of more than 10 percent must be communicated in writing (eg by e-mail) by 24 hours before the start of the tour and confirmed by Berlins Taiga.

If the number of participants is reduced by the client without prior cancellation or notification, Berlins Taiga is entitled to charge or retain the full fee.

In the case of an unconfirmed increase in the number of participants, Berlins Taiga reserves the right to exclude the additional participants from the tour, if the maximum group size is exceeded. This is especially so in the light of the fact that Berlins Taiga guarantees a small group size at public tours, in order to guarantee quality.

Clients who are recognizable under the influence of intoxicating substances or alcohol, that permanently disturb the procedure of the tour, behave inappropriately, endanger themselves or other persons, do not follow the instructions of the guide, don´t accept the disclaimer of liability for certain objects, can be excluded by the guide. If possible, the exclusion is to take place once the person/s has/have been warned. The fee will not be reimbursed to the excluded client.

Data protection

Berlins Taiga takes the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the legal data protection regulations as well as this data protection statement.

The use of our website is normally possible without giving personal data. If personal data (for example name, address or e-mail addresses) are collected on our pages, this is always done on a voluntary basis as far as possible. These data will not be passed on to third parties without your express consent.

We would like to point out that the transmission of data on the Internet (for example, by e-mail communication) may present security gaps. A complete protection of the data before access by third parties is not possible.

The client agrees that the data provided by Berlins Taiga for the booking of the agreed service may be used for customer service.

Severability clause

Should one or more terms of this agreement be invalid, the legal effectiveness of the other provisions is not affected.

We reserve the right to change programs and charges as well as changes in the general terms and conditions.

The legal status is Potsdam. Only German law applies.
